These terms explain how you may use hzempower.com.au (the Website). By accessing or using the Website you agree to these terms. If you do not agree, please stop using the Website.

2. How these terms apply

These terms apply to your use of the Website, which includes browsing pages, reading content, submitting a contact form, or otherwise interacting with anything we publish on hzempower.com.au. If you become a client and engage us for services, the commercial terms of that engagement are governed by our Master Services Agreement and any signed Statement of Work, which sit separately to these terms. Where the Master Services Agreement and these terms conflict in the context of a client engagement, the Master Services Agreement prevails.

3. Using the Website

You may use the Website for your own information and to learn about our services. When you use the Website, you agree not to:

  • use the Website in a way that is unlawful, misleading, fraudulent, or likely to harm us or another person,
  • interfere with or disrupt the Website, including by introducing viruses, trojans, worms, or other malicious code,
  • attempt to gain unauthorised access to any part of the Website, any server it runs on, or any related system or network,
  • scrape, harvest, or systematically extract content from the Website other than by a standard search engine crawler operating within the rules we publish in our robots.txt,
  • use the Website to send unsolicited marketing, harvest contact details, or impersonate any person or entity,
  • use any automated means, including bots or scripts, to submit forms or generate traffic on the Website.

We may suspend, restrict, or terminate your access to the Website at any time without notice if we reasonably believe you have breached these terms, or if we need to protect the security or integrity of the Website.

Where we are permitted by law to limit our liability for a breach of a consumer guarantee, our liability is limited to, at our option, supplying the services again or paying the cost of having the services supplied again.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive loss, or for any loss of profits, revenue, business opportunity, goodwill, data, or anticipated savings, arising out of or in connection with your use of or inability to use the Website, even if we have been advised of the possibility of such loss.

Where our liability cannot be excluded but can be limited, our total aggregate liability to you for all claims arising out of or in connection with the Website is capped at AUD $100.

This clause does not limit our liability for fraud, wilful misconduct, death or personal injury caused by our negligence, or any other liability that cannot be limited under applicable law.

9. Indemnity

You agree to indemnify us and hold us harmless from any claim, loss, damage, cost, or expense, including reasonable legal fees, that we suffer or incur as a result of your breach of these terms, your misuse of the Website, or your infringement of any law or any third party's rights in connection with your use of the Website.

11. Changes to the Website and these terms

12. Governing law and jurisdiction

These terms are governed by the laws of Queensland, Australia. You and we submit to the exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia in relation to any dispute connected with these terms or the Website.

13. General

If any part of these terms is found to be invalid, illegal, or unenforceable, that part will be read down to the extent necessary so that it is enforceable, or if that is not possible, severed from these terms, without affecting the remaining terms. A failure or delay by us to enforce any right under these terms is not a waiver of that right. These terms, together with our Privacy Policy and, where applicable, the Master Services Agreement and any Statement of Work, set out the entire agreement between you and us in relation to your use of the Website.
